Terms of Use
The rules for using Kioku Kabegami.
This is an English translation of the Japanese Terms of Use. The Japanese version is the official version, and if the two differ in content or interpretation, the Japanese version prevails.
These Terms of Use (the "Terms") govern the use of "Kioku Kabegami" (the "Service") provided by 3rd-Party.jp (the "Operator," "we" or "us"). They apply to everyone who uses the Service ("you" or "users"). When you save a wallpaper or a photo, we ask you to agree to these Terms and the Privacy Policy. By checking the consent box and saving, you agree to these Terms.
Article 1. About the Service
The Service lets you view old photos and nishiki-e (Japanese color woodblock prints) whose copyright protection has expired (together, "photos") and turn them into wallpapers for smartphones and computers. No registration is required. The Service is free of charge. The Service displays advertisements (Article 8).
Article 2. Saving and publishing Works
- When you save a wallpaper, that wallpaper (a "Work") is also published in the Service's listings and on its own Work page.
- Works whose caption you have edited yourself are published after the Operator reviews them.
- The Operator receives only how a Work was made (which photo, and the design, size, position of the text, font weight and caption) and the records described in the Privacy Policy. The Operator never receives your own images or photos.
- You keep the rights to the parts of a Work that you entered, such as the caption. Free of charge and without limitation as to period or territory, you permit the Operator and other users to publish and display Works within the Service and to build on and edit Works as described in Article 3, and you permit the Operator to use Works to introduce the Service.
- You agree not to exercise your moral rights against the Operator or other users with respect to the uses in the previous paragraph.
- You are responsible for the captions you write. Do not write anything that infringes the rights of others or violates the law.
Article 3. Building on and editing Works
- Anyone may use a published Work as a starting point for a new Work.
- Anyone may edit a published Work, such as the position of its text or photo, and replace the Work with the edited version. The photo, caption and size cannot be changed.
- One previous version is kept, and the Operator may restore it.
- You agree that the Works you save are handled as described in this Article.
Article 4. Photos and sources
- The photos used in the Service are items that the National Diet Library of Japan publishes online because their copyright protection has expired.
- A source credit is added automatically to Works and to photos saved from a photo page. The credit is in the language of the page you are viewing, or the language you choose when saving. You cannot remove or change the source credit.
- The copyright protection of the photos themselves has expired, and the Operator claims no rights in them. When you use them, we ask that you keep the source credit.
- Use of the photos themselves is subject to the National Diet Library's terms of use.
- People, buildings, signs and other things shown in a photo may be subject to rights other than copyright (such as portrait rights or trademarks). If you use a photo for anything other than a wallpaper, such as printed matter or products, please check these rights yourself.
- Some photos and material titles in the Service retain the expressions and views of the time when they were taken or published. The Operator presents them unaltered as historical records of the customs and daily life of that time, with no political or ideological intent.
Article 5. Using saved wallpapers and photos
You may freely use saved wallpapers and photos, for example as the wallpaper of your own devices. You may also share them on social media. When you do, please do not remove the source credit they contain.
Article 6. Prohibited conduct
- Writing captions that contain hurtful language, other people's personal information, or advertising, or that otherwise violate the law, public order or morals
- Infringing the copyright, portrait rights, privacy or other rights or interests of others
- Using programs or similar means to make many Works or save many photos in a short time
- Automatically extracting photos or information from the Service in bulk (such as scraping)
- Placing a load on the servers of the Service or of the National Diet Library, or interfering with the operation of the Service
- Unauthorized access, or attempting it
- Distributing wallpapers or photos from which the source credit has been removed
- Clicking advertisements fraudulently, or asking others to click them
- Violating laws, or conduct connected with crime
- Any other conduct that the Operator considers inappropriate
Article 7. Removing Works and suspending use
- The Operator may, without notice, hide from the listings or remove any Work that it considers to fall under Article 6, or any Work it has been asked to remove. The Operator may do so without giving reasons.
- If you would like a Work removed, please let us know through this site's contact form, including the URL of the Work page and the reason and grounds for the request. We may not be able to accept a request whose grounds we cannot confirm.
- The Operator has no obligation to monitor the content of Works.
- The Operator may prevent a user whom it considers to have acted as described in Article 6 from using all or part of the Service, including by blocking IP addresses. The Operator may do so without notice and without giving reasons.
- We do not accept requests to remove photos or Works for political or ideological reasons based on historical expressions in photos or material titles, or on what a photo shows (Article 4).
Article 8. Advertising
- The Service displays advertisements. They include links that introduce products and services (affiliate links) and ads served by advertising vendors such as Google. Our affiliate partners include Amazon sites in Japan and other countries (such as Amazon.co.jp and Amazon.com), and travel booking services. Which partner is shown depends on the language of the page.
- When you buy a product or similar through an advertising link, the Operator may receive a referral fee from its partner. The price you pay does not change.
- Advertisements are labeled "PR," "Ad" or an equivalent term in the language of the page. Affiliate links also carry a marker, intended for search engines and similar services, indicating that they are paid links.
- The products and services behind advertisements are provided by their respective advertisers or sellers. Their content, and any transaction between you and an advertiser or seller, are matters between those parties.
- As an Amazon Associate I earn from qualifying purchases.
Article 9. Changes to and suspension of the Service
The Operator may change, suspend or end the Service without notice, and may delete Works and records when doing so. If the Operator ends the Service, it will announce this on this page in advance where possible.
Article 10. Liability
- The Service is provided free of charge and as is.
- The Operator does not promise, for example:
- that the Service will be free of errors or interruptions, or always available
- that photo names, places, dates, descriptions and similar information are accurate (they are compiled from the source materials and from the Operator's own research)
- that Works, Work pages, or saved wallpapers and photos will remain available forever
- that wallpapers will display as you expect on your device or settings (for example, text hidden behind the lock-screen clock, or edges cut off)
- that the Service will suit your purposes
- You are responsible for judging and handling the following yourself:
- checking rights relating to people, buildings, signs and so on shown in a photo when you use saved wallpapers or photos for anything other than a wallpaper, such as printed matter or products (Article 4)
- dealings or disputes with others after you post on social media
- purchases or bookings at the destination of an ad (Article 8)
- your device settings, data charges, and backups of the images you save
- If you suffer damage due to the Operator's non-performance of its obligations or its tort, the Operator will compensate you only for the direct and ordinary damage you actually suffered, up to 10,000 yen, unless the damage was caused by the Operator's intentional misconduct or gross negligence. This compensation does not include damage arising from special circumstances or lost profits.
- If a third party makes a claim or complaint against the Operator concerning your violation of these Terms or a caption you wrote, you shall resolve it at your own responsibility and expense.
- If you violate these Terms and the Operator suffers damage as a result, you shall compensate the Operator for that damage.
Article 11. Changes to these Terms
The Operator may change these Terms when the change is in the general interest of users, or when it is reasonable in light of its purpose, necessity and content (Article 548-4 of the Civil Code of Japan). Before a change takes effect, the Operator will announce the changed content and its effective date on this page. If you use the Service after the effective date, you are deemed to have agreed to the changed Terms.
Article 12. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's location as the court of first instance. However, this Article does not take away any right that the laws of your country or region of residence mandatorily give you as a consumer.
Article 13. Language
These Terms are written in Japanese, and the Japanese version is the official version. Versions in English and other languages are translations provided for readability. If they differ in content or interpretation, the Japanese version prevails.
Article 14. Severability
If any part of these Terms is held invalid or unenforceable under applicable law, the remaining parts remain in effect.
